Terms of Service
1. Who we are
"KinetiQsport", "we", "our" and "us" refers to the operator of kinetiqsport.com. By creating an account or using the service, you ("you", "the user") agree to these Terms of Service.
If you don't agree, please don't use the service.
2. The service
KinetiQsport is a web application that lets sports coaches:
- Track matches in real time on a phone, tablet or computer;
- Generate AI-powered tactical analysis and training plans;
- Aggregate season statistics for their teams and players.
The exact set of features may change over time. We may add, modify, or remove features at our discretion. Material changes will be communicated to you via email or an in-app notice.
3. Account creation
To use the service you must create an account with a valid email address and a password. You are responsible for keeping your password secure. We won't be liable for any loss caused by unauthorised access if it results from your password being shared, weak, or reused.
You must be 18 or older, or have the consent of a parent or guardian, to create an account.
One person, one account. You may not create multiple accounts to bypass tier quotas (see Section 5).
4. The 15-day free trial
Every new subscription starts with a 15-day free trial. During the trial:
- You have full access to all features of the tier you chose;
- A valid payment method may be required at checkout, but you will not be charged until day 16;
- You can cancel any time by visiting the billing portal — you won't be charged a cent.
If you don't cancel before the trial ends, the subscription will renew automatically and you will be charged the recurring fee for the tier you chose.
5. Subscription tiers
KinetiQsport is offered in three tiers, each with a different team-slot quota:
- Starter — 1 team slot.
- Pro — up to 5 team slots.
- Elite — up to 10 team slots.
A team slot can be used to track either a full team or an individual athlete. Quotas are enforced at the database level: trying to create more teams than your tier allows will fail.
Prices are shown on the pricing page in EUR, USD and GBP. Stripe will display the local currency at checkout based on your location. Prices may change in the future; existing subscribers will be notified at least 30 days before any price change takes effect, and may cancel before then to avoid the new price.
6. Payment, renewal, and cancellation
- Subscriptions are billed monthly in advance.
- Payments are processed by Stripe; we never see or store your card number.
- You can cancel any time from the Stripe customer portal. After cancellation you keep access until the end of the current billing period.
- We do not provide pro-rata refunds for partial months, except where required by consumer-protection law.
- If a payment fails, Stripe will retry for up to two weeks. During that time, your access is paused. If the retry succeeds, full access is restored. If it doesn't, your subscription is cancelled and your data remains stored under the deletion timeline in Section 13.
7. Acceptable use
You agree not to:
- Use the service for anything illegal, harmful, or that infringes someone else's rights;
- Reverse-engineer, scrape, or copy the service;
- Use the AI features to generate disallowed content (hate, violence, illegal advice, etc.);
- Attempt to circumvent the team-slot quotas, rate limits, or authentication;
- Resell or sub-license access to the service without our written permission.
We may suspend or terminate any account that breaches these rules, without refund for the current billing period, and may report serious abuse to the relevant authorities.
8. Your data, your content
You own the matches, players, formations, notes and other content you create in the app. We do not claim any ownership of that content.
By using the service, you grant us a limited licence to store, process, and transmit that content as needed to operate the service, generate AI analysis, and back up your data.
If you record a third party (for example, a player on your team), you confirm that you have the right or consent to do so. Privacy Policy Section 7 explains your obligations when recording minors.
9. AI-generated output
The AI Coach, AI Training Plan, and support chat use third-party large language models. AI output is generated probabilistically and may contain inaccuracies. You should review it before acting on it. We are not liable for coaching, training or recovery decisions you make based on AI output.
Per our agreement with our AI provider, your data is not used to train their models.
10. Service availability
We aim for high availability but do not guarantee uninterrupted service. Maintenance, third-party outages (Supabase, Netlify, Stripe, Anthropic, etc.) and force-majeure events may temporarily affect access. We will not be liable for damages caused by such interruptions.
11. Limitation of liability
To the fullest extent permitted by law, KinetiQsport's total liability to you for any claim arising out of or related to the service is limited to the amount you paid us in the twelve months preceding the claim.
We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of data, loss of profits, or loss of reputation.
Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law (such as gross negligence or wilful misconduct).
12. Termination
You can close your account at any time by emailing support@kinetiqsport.com or via the in-app account-deletion flow when available.
We may close your account if you breach these Terms, if your subscription has been unpaid for more than 60 days, or if we are legally required to.
13. Data after termination
When your account is closed, your matches, AI analyses, training plans and squads are deleted within 30 days. Billing records are kept for 7 years as required by Spanish tax law. See the Privacy Policy for full details.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app banner at least 30 days before the new version takes effect. Continuing to use the service after the new version takes effect counts as acceptance.
15. Governing law and jurisdiction
These Terms are governed by the laws of Spain. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Barcelona, Spain, unless mandatory consumer-protection law gives you the right to bring proceedings in your own country.
EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
